The Workers’ Compensation Board has recently determined that medical marijuana may be prescribed to treat injured workers, and workers’ compensation insurance carriers may be directed to reimburse workers’ compensation claimants for out-of-pocket medical marijuana purchases. However, in order for this medication to be covered under your claim, your medical provider must request and obtain prior authorization through the Variance process to prescribe medical marijuana.
This process can be lengthy and confusing and typically requires both hearings and medical testimony. Our experienced workers’ compensation attorneys can help you to navigate the Variance process; work with your medical providers to ensure necessary medical evidence is timely obtained and sufficiently detailed; and argue on your behalf in front of the Workers’ Compensation Board.
