The Workers’ Compensation Law allows for a “reduced earnings” award. If you return to work making less money than you earned prior to your injury, your workers’ compensation insurance carrier may be required to compensate you for two-thirds of the difference between your new earnings and what you made at the time of your injury. This award must be supported by medical evidence and can involve attending hearings, providing documents to verify your income, and even taking your sworn testimony.
